2 i; A9 ]7 b3 w7 F+ i 在人们日常生活中,玩牌、打麻将是常有的事情,在财物上有个输赢也很普遍。但输赢多少就要受到法律的惩处呢?法律又是如何规定的?! H" Q; R$ |% z5 ]5 ~1 @
现行的治安管理处罚法第70条规定,以营利为目的,为Dubo提供条件的,或者参与Dubo赌资较大的,处五日以下拘留或者五百元以下罚款；情节严重的,处十日以上十五日以下拘留,并处五百元以上三千元以下罚款。
+ ~- l0 s3 j: _" d对于严重的Dubo行为构成犯罪的,刑法第303条规定,以营利为目的,聚众Dubo、开设DC或者以Dubo为业的,处三年以下有期徒刑、拘役或者管制,并处罚金。; N) _' D V+ N3 U' _
可见,法律对于以营利为目的,或者赌资较大的Dubo是严厉惩处的。但是,像范先生和老乡们“斗地主”是否属于应被拘留的Dubo行为?邓警官认为一块钱的Dubo也算违法的说法是否成立?- D9 d) `; R. J" ]$ Q1 _& I+ O
治安管理处罚条例第32条规定,Dubo或者为Dubo提供条件的处十五日以下拘留。不过,随着治安处罚法自2006年3月1日起施行,治安管理处罚条例同时废止。按照我国法律精神,江门警方依据治安管理处罚条例拘留范先生等3人是错误的。如果他们3人的行为应受惩处,也应依据治安处罚法处理。
# F3 I7 b4 p/ A$ O7 |+ i' j 如前文所述,虽然法律明确规定营利性Dubo及赌资较大的应受处罚,但如何认定“以营利为目的”及“赌资较大”,一直未做出明确规定。
+ M+ a9 E& {. V; r/ n" T* s+ Q 2005年,公安部“关于办理Dubo违法案件适用法律若干问题的通知”第9条规定,不以营利为目的,亲属之间进行带有财物输赢的打麻将、玩扑克等娱乐活动,不予处罚；亲属之外的其他人之间进行带有少量财物输赢的打麻将、玩扑克等娱乐活动,不予处罚。
/ y4 a) J1 M+ Z这一规定明确肯定了部分Dubo行为属娱乐活动,不属违法,更不是犯罪。那么,到底“少量输赢”是指多少钱呢?是否一块钱就不算“少量”?
{0 f7 R6 o, X* M q: t. u有专家指出,认定赌资大小不能脱离当地的经济水平及当地老百姓的普遍观念,如果老百姓普遍认为某种水平属于“少量输赢”,法律就没理由介入。 薛发
